These Terms of Service (the "Terms") govern your access to and use of Kintinery — the website at kintinery.com, the Kintinery iOS app, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Kintinery is operated by Kintinery LLC, a limited liability company organized under the laws of the State of Florida ("Kintinery", "we", "us", "our"). You can reach us at aloha@kintinery.com.
You must be at least 13 years old to use the Service. If you're under 18, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
You're responsible for keeping your account credentials secure. Don't share your password. Tell us promptly if you suspect unauthorized access.
When you create an account, you give us an email address and a display name. You agree to provide accurate information and to keep it current. You may delete your account at any time from the Profile screen in the app or by contacting us — deletion permanently removes your profile, chat history, and any solo trips you own.
We may suspend or terminate your account if you violate these Terms, abuse the Service, or use it for illegal purposes. We'll try to give you reasonable notice except where immediate action is necessary.
You retain ownership of the trip details, photos, itinerary items, comments, chat messages, and other content you create or upload to Kintinery ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely as needed to operate the Service for you and any trip members you've invited.
This license ends when you delete Your Content or your account, except where we need to keep backup copies for a reasonable period or where required by law.
You're responsible for Your Content. You agree not to upload anything that:
We don't routinely monitor user content, but we may remove anything that violates these Terms and we may report illegal content to authorities.
You can invite people to a trip as a member with a specific role (owner, co-planner, contributor, or viewer). You can also generate a public share link, optionally protected by a password.
If you generate a share link, anyone with that link (and password, if set) can view the trip. We can't control further sharing once you distribute the link — revoke it from trip settings if needed.
You're responsible for the privacy of trip data you share. Don't share trips containing other people's photos or sensitive information unless you have permission.
The Service uses Anthropic's Claude AI to power features like the in-trip AI chat, document parsing, and itinerary extraction. AI output is generated automatically and may contain mistakes — verify any AI-suggested bookings, dates, prices, or addresses before relying on them.
Content you send to the AI (your chat messages, uploaded documents, itinerary text) is processed by Anthropic on our behalf. Anthropic does not use API content to train models, and retains it only for limited abuse-monitoring purposes (currently up to 30 days). See our Privacy Policy for full details.
Kintinery offers paid features under two products:
Pricing is shown in your local currency on iOS by Apple based on Apple's regional pricing tier. Pricing may change with notice; existing subscriptions renew at the price they were originally purchased at unless we tell you otherwise.
If you purchase Pro Annual through the Kintinery iOS app, payment is processed by Apple under your Apple ID. The following disclosures apply, as required by Apple:
Title of publication / service: Kintinery — Pro Annual.
Length of subscription: One year (12 months), auto-renewing.
Price: $19.99 USD per year (or the local equivalent set by Apple's pricing matrix). If you qualify for the Trip Credit introductory offer, the first year is $14.99 USD and subsequent renewals are $19.99 USD per year.
Payment: Payment is charged to your Apple ID account at confirmation of purchase.
Renewal: Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period at the renewal price.
Managing your subscription: You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase. The Kintinery app also includes a "Manage Subscription" link on your Profile screen that opens Apple's subscription management directly.
Introductory offers: Any unused portion of an introductory offer period is forfeited if you cancel the subscription before the offer period ends.
If you purchase Pro Annual through the Kintinery website, payment is processed by Stripe. Your subscription auto-renews at the end of each one-year period at the renewal price. You can cancel at any time from your account settings, which opens Stripe's customer portal — cancellation prevents the next renewal but does not refund the current period.
iOS purchases (Apple): Refunds for purchases made through the iOS app are handled by Apple under Apple's refund policies. Kintinery cannot directly refund Apple-processed transactions. To request a refund, visit reportaproblem.apple.com within the time window Apple allows.
Web purchases (Stripe): We may, at our discretion, refund web purchases within 30 days of purchase if you contact us at aloha@kintinery.com with a reasonable explanation. We don't pro-rate refunds for partially-used subscription periods, but we'll consider exceptional circumstances case-by-case.
Without a Pro upgrade, you can use most of the Service for free, with limits on things like the number of photos per trip, AI chat messages per month, available themes, and trip length. We may change these limits with notice. Anything you've already created stays accessible, even if a feature later moves behind a Pro tier.
You agree not to:
The Service — including the Kintinery name, logo, design system, source code, and all content we create — is owned by us and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. No other rights are granted.
The Service relies on third parties (Apple App Store, AWS, Anthropic, Stripe, Apple WeatherKit, Unsplash). Your use of features that depend on those services is subject to their respective terms. We're not responsible for outages, errors, or policy changes by those providers.
The Service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, secure, or that AI suggestions will be accurate. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Travel itineraries can change. Always verify bookings, addresses, opening hours, and confirmation codes directly with the underlying provider before relying on them.
To the maximum extent permitted by law, Kintinery and its operators won't be liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or trip-related costs — arising out of or related to your use of the Service.
Our aggregate liability for any direct damages will not exceed the greater of (a) the amount you paid Kintinery in the 12 months before the event giving rise to the claim, or (b) $50 USD.
Some jurisdictions don't allow these limitations — in that case, our liability is limited to the smallest extent permitted by applicable law.
You agree to indemnify and hold Kintinery harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or someone else's rights.
We're a small team shipping a product. We may add, change, or remove features, including paid features, at any time. We'll try to give reasonable notice for material changes. If a change materially reduces a Pro feature you paid for, we'll do our best to honor what you paid for or offer a fair alternative.
We may update these Terms. When we do, we'll update the "Last updated" date at the top of this page, and for material changes we'll give reasonable advance notice — typically by email or an in-app message. Your continued use of the Service after the change takes effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms or the Service is the state courts located in St. Johns County, Florida, and the United States District Court for the Middle District of Florida (Jacksonville Division) — both parties consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
You can terminate these Terms at any time by deleting your account. We can terminate or suspend your access at any time for violations of these Terms or for risk to the Service. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.
If you obtained the Kintinery iOS app from the App Store, the following apply in addition to (and supersede where conflicting with) the rest of these Terms:
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of our assets.
